Bankruptcy
The Heavner, Scott, Beyers & Mihlar, LLC bankruptcy department has experience in representing creditors in all aspects of bankruptcy proceedings. The attorneys are assisted by a team of bankruptcy specialists with extensive experience in handling bankruptcy matters on behalf of mortgage lenders and creditors. The firm handles cases in all 3 of the states’s bankruptcy districts. As a part of the service offered to clients, our attorneys review the plan and schedules filed in each Chapter 11 or 13 case to determine whether an objection to confirmation should be filed. This is important because all 3 districts in the state hold that the amount set-forth in the confirmed plan is controlling and not the amount set-forth in the creditors’ proof of claim. The bankruptcy department provides the following services to mortgage lenders and creditors: proofs of claim, confirmation proceedings, motions for relief from stay and motions for adequate protections, adversary proceedings and defending preference claims.
Eviction
Heavner, Scott, Beyers & Mihlar, LLC routinely handles eviction related matters for mortgage lenders after foreclosure and for landlords. The firm understands the importance of initiating eviction proceedings in a timely manner so that our clients can market properties as soon as possible. The eviction proceeding are monitored on a daily basis to ensure that there are no delays in securing property vacancies so that REO marketing can be initiated. All necessary actions are taken to mitigate losses caused in any delays in securing vacancies.
Litigation
Our firm’s litigation department has extensive experience in identifying and minimizing potential counterclaims, mitigating damages and resolving cases in a timely and cost effective manner. The litigation department handles contested foreclosures, title claims, rescission claims, RESPA claims, TILA claims, mechanic lien claims and issues relating to all aspects of real estate litigation.
REO Closings
As a part of our complete offering of services, once the foreclosure is completed and eviction completed, Heavner, Scott, Beyers & Mihlar, LLC will handle the closing of your REO property. Combined with our foreclosure expertise we will complete tax and title search services to ensure that the property is liquidated quickly and efficiently. Our ability to represent our clients from foreclosure through eviction and REO closings, will eliminate potential delays.
Loss Mitigation
Heavner, Scott, Beyers & Mihlar, LLC recognizes the importance of identifying and reducing delinquencies through our loss mitigation specialists who will work with lenders to identify and facilitate loss mitigation opportunities based on the intentions of the debtor and the ability to retain ownership of the property, including Deed in Lieu, Forbearance Agreements, Loan Modification, Short-Sale, Reinstatement and Payoff opportunities. Our staff will communicate with the client/lender and the borrower to assist with the preparation of the necessary documentation and complete the process in a timely manner.
Collections
Our collection department offers a full service practice, including collection letters, filings suits and obtaining judgments, replevins, post-judgment work including wage garnishments, bank garnishments and liens on property. Our collection department partner has over 20 years of experience and works directly with lenders to identify and prosecute cases at the least cost to our clients. In addition, our competent staff will effectuate communications between the client and borrower to assist in expediting the process and obtaining the most cost effective solution to our clients. |
